Company is not paying salary

Hi all,

My partner’s pay has not been paid on time and the company has refused to pay for two weeks – this obviously is having a financial impact on our lives/family and could get worse sooner rather than later. It won’t affect us too badly, however she is feeling rather distressed at the moment.

In this instance, is there anything within her rights that she can take action on in this scenario or is she basically going to get screwed over? She is a Japanese native. The company has used every excuse under the sun, such as that it is a payment delay issue from an international bank, but when the staff ask when their pay will come, the question is dodged by HR & they refuse to say that they are in financial distress or give any explanation as to why payments have not been made. My partner doesn’t have access to their financial records.

She of course will immediately begin her search for a new job, but in the interim, any help would be sincerely appreciated for those who have been in this situation before on suggesting a plan of action.

EDIT: I should add that the company is very small, only a total number of employees <50.
