Hello, I’m on the process of moving out of an apartment in Tokyo and I was checking about things I’ll have to pay (wall stains, air conditioning cleaning, cleaning fee, etc) and I was wondering if the apartment managing bears any responsibility of damages done to my bicycle from poor parking conditions.
To elaborate, the bicycle parking spot for people living in that apartment is assigned by the room number, having bicycle rails in where we are supposed to put our bicycles in. The issue is that my assigned spot is on the edge most spot which means that the roof of the parking spot barely covers it. This has lead to my bicycle getting damaged from the weather quite badly (seat cushion is broken, bicycle has rust, etc). However none of the other bicycles show anywhere close to the same damage because they are actually properly covered by the little roof.
When I handed out the keys there was a person that came to make an assessment of things I’d have to pay for from the managing company. At that time I mentioned that the parking my bicycle in my assigned spot had done this to my bicycle and he told me that he would ask the managing company if there was any kind of compensation that can be done to me for it (for example, a discount in the things I’d have to pay for). I recently got the final quotation, and they told me the managing company did not bear any kind of responsibility for it.
My question is, are there any legal stipulations or guidelines that define who bears responsibility for when things like this happen? Is it true I’ll just have to pay for the repairs of my bicycle from my own money?
