Unpaid time off work first deducted from overtime pay – is this legal?

I need to take a day off due to an emergency medical appointment. However, I’m a haken employee, so I don’t have any paid vacation or sick time for the first 6 months. Therefore, this one day is deducted from my salary. My monthly pay is based on me working 40 hours per week.

However, my company just told me it will not be the same as an unpaid day of work, but in fact the 8 hours will be *subtracted from my overtime hours* (past or future), which is supposed to be paid at 1.25x my base rate.

Is this legal?
