What’s the point of car insurance?

**Context:**

So 2 days ago my fiancé (we’re both foreigners) got hit by a car while driving to get groceries. The other car ran a stop sign and hit her rear left corner (T-bone but more to the rear so like an L-bone?). The other car was a rental (toyota rental) with a group of Chinese tourists who somehow were driving without a license?

**Rant:**

After making the police report and exchanging insurance info, we get a call the next day from their insurance telling us we need to go through our own insurance. Our insurance is saying they got the police report and will handle the repairs to our car and that quote “the majority of responsibility is on the other car, but you still need to be careful so you have 20% fault”. I was expecting this since I know thats how it works here, but what really confounds me is that they are telling us that they can only cover up to 450,000 yen with a 50,000yen deductible and will not pay for a temporary rental while its at the shop.

WTF? These are the constraints of my plan, why would we be using that? Shouldn’t the other insurance cover everything up to %80? If I need a rental shouldn’t they pay %80 of it? Like what is the point of my insurance if the result is the same whether I’m the cause of the accident or the victim? By this logic if it were the same accident but with the roles reversed, I would still be the same situation: down 50,000yen for a deductible and having to pay out of pocket for a rental + higher premiums. But in that scenario it would at least be fair since I CAUSED THE ACCIDENT.

I’m sorry for the rant this just pisses me off so much. We get hit while driving and now have to either spend a bunch of money on repairs/rental/higher premium or take a loss on the value of the car (damage was only aesthetic). I get that the whole “you always have some fault, you could’ve stopped, been more careful, bla bla bla” thing is how it works here but if the % of fault doesn’t apply to liability of the drivers then what’s the point? I guess I should just assume that every accident here is like getting into a hit and run since it seems like the % of fault thing is only for the insurance companies to find out how much to pay each other.
