Changing the locks to my house… and divorce

Will i be able to divorce my japanese husband if i change the locks to the key?

Im an american married to a japanese guy. Relationship took a downturn after the baby was born. Husband lost any kind of love for me and although he was a good father to the kid, he kicked our child and myself out after a fight and he brought out dicorce papers as well. As it was the 2nd time he did this i went ahead and got a place for my kid and myself. This was last october. Now for a couple months there was limited contact but during visits with our child he told me he doesnt want a divorce and i mistakenly and stupidly thought maybe it can work out for our child and gave him a key to my place. Now he is living here but has not paid rent and told me he will not pay as this is my place. He is a good father to our child. But i caught him sneaking through my purse and its making me feel very uncomfortable. I asked him to leave numerous times but he has notm i hired a lawyer last october for the divorce and the lawye4 tells me that i wont be able to kick him out as we are married on paper. I asked if i can change the lock but the lawyer advised me against it as it will look bad in court in the future. But then i cant go to court yet since i need 3 years of seperate place of residence in order to go to court. Unless theres dv or affairs which there is not.
I feel stuck and want to just change the lock anyway… any advice or tips on this matter? Even if i cannot divorce him i want him out of the house…..the house is purchased and it is not easy to move especially finding a hoikuen for a 1 year old.
