I’m going to be a bit vague and not reveal the company name outright so I don’t potentially get sued, but let me explain…
A few months ago I was finishing up study abroad in Japan. I realized study abroad students can’t switch to a job hunting visa even if I was on my way to finish university (which I have now done pending graduation formalities). So instead I applied to companies willing to sponsor foreigners for a change of status of residence and got through both interviews of one company to the point where I was emailed an offer for a specific office, mailed the documents necessary to apply for the change at immigration and I went ahead and applied before I left Japan on a special re-entry permit to walk for graduation in the US. I was also told I needed to complete pre-employment training prior to signing of the final contract, but the company still sponsored the visa and gave immigration a letter on company seal, loads of financial documents, etc. required to make that change viable.
The problem is the online training…the instruction is just not there. I really want to do well but there isn’t much guidance and so I made it to the final task but I failed once and only get one more attempt to get it right, so I’m nervous I could slip up again…
My question is, I have emails stating the exact office I will be working in pending the completion of pre-employment training, my visa application was marked by the company as me beginning work as soon as it will be approved and they even went ahead to declare to immigration that I have a 1 year offer, the amount and the stamped company letter required for the visa change.
Can the company legally rescind my contract if I fail the final task a second time (I’m not trying to fail, I really want to pass…)?
