Can I change my kid’s last name without the mom having to change hers?

So as everybody knows the Koseki (birth certificate) can only have the lastname of the Japanese parents at birth, but I’m wondering if later on it could be possible to change his lastname to mine without the mom having to change hers? Maybe in a court trial? I find it quite unfair that my kid cannot have my surname too.
