Nenkin page display different from contract.

Hi, currently I'm working at Japan with gross salary (no OT) at 195k yen, but today when I check on Nenkin.co.jp page, it shows that I'm at 220k yen, with pic.

I'm unsure if I should ask HelloWork on this matter, since this is some kind of fraud action and I don't want to be involve into any illegal matters. Or just to settle down with my company first ?

Moreover, If I choose to keep silent, what could be the punishment that I could face in the future?

  1. 195k could be after the company takes away withholding tax. It starts around 10.21% and can be higher.
    Ask the company to give your your pay slip every month as well.

Your “standard monthly remuneration” is based on [this table](https://www.kyoukaikenpo.or.jp/~/media/Files/shared/hokenryouritu/r6/ippan/r60213tokyo.pdf), and so if your salary were really 195k then the SMR would be 200,000, but your SMR is 220,000 which means that your actual salary was between 210k and 230k. This number is based on the average of your salary from April to June. Your new premiums then start from September.

    Presumably, you had some overtime or other stipend during this time period (a 20,000 yen commuting stipend, perhaps?). That would make your monthly remuneration 215,000 per month, which would make perfect sense.

    Companies have to pay for half of your Shakai Hoken, and there’s a zero percent chance that they are making it higher than necessary for no reason. They’re definitely not committing fraud in order to pay slightly higher premiums for themselves. When a company commits fraud, they generally try to make things cheaper for themselves, not more expensive. There’s no punishment for that.

    Your average salary is slightly higher than you think, or at least it was for the April to June time period. Please check your salary statement carefully.

    I’m willing to bet if you argue with your company about this and accuse them of illegal activity when they are doing everything right, you’ll look very foolish.

    (Note that while commuting stipends are tax free for income tax purposes, they count towards your average monthly remuneration for Shakai Hoken purposes)

  3. Firstly, good job in checking your Nenkin Net. More people should be doing this 👍

    The important thing is to make sure the deduction on your payslip in reality reflect your SMR. For for ¥220,000 make sure you’re only getting ¥20,130 deducted from your payslip (amount from this table https://www.nenkin.go.jp/service/kounen/hokenryo/ryogaku/ryogakuhyo/20200825.files/R06ryogaku.pdf) anything more than that, would mean your employer is screwing around. (Edit: to clarify, for pension only! Of course you will still get health insurance and employment insurance deducted. So just focus on the pension amount withheld on payslip)

    The next thing is to understand how that figure got determined. SMR is calculated every year on a total average of your salary+allowances (such as transport reimbursements) from april, May, and June and then reflected from September.

    So given your salary is ¥195,000, do you by any chance claim ¥15,000 to ¥35,000 per month in transport? If so that would likely explain why you’re in the ¥220,000 SMR bracket (as that covers average salary+allowances of ¥210,000 to ¥230,000)
