Going back to work after two consecutive child care leaves has not been easy on me. Plus lots of other pressures and issues. As expected my performance at work is far from what is required. I started taking counseling from EAP services provided by the company. However, just recently had a conversation with line manager and hr that my situation is becoming “severe” so they have to take measures, eg have some sort of agreement created where it would be stated something like “if I don’t get the performance that is required for my position within *** time period, there will be some measures taken”. Plainly speaking, being fired.
I’m thinking of organizing a medical leave due to mental health issues for the next 3-6 months (I think my company allows up to 9 months medical leave).
1. Will it be counted as official medical leave so that health insurance provides 65% of monthly wage?
2. Is it allowed to dismiss an employee when he/she decides or while he/she is taking medical leave?
3. Is it legal to pressure an employee while he/she is undergoing counseling provided by the company?
