Is this considered overtime pay?

Hey guys, sorry if this is a dumb question, I just don’t quite understand how this stuff works.
Basically, I work in a kitchen on a salary pay, and we’re guaranteed 256 days of work per year. We’ve been working 3/4 days a week since March due to low demand for our product. When it ramps up during holidays, I’ve noticed were all now scheduled to work 6 days each week for about 3 months. Normally, I’d just assume it’s overtime during an hourly wage, but we’ve been getting paid for 40 hours a week all year despite the hours we’ve been working. Should we be getting an overtime rate during these extra work days, or will the salary remain the same?

  1. If your job is salary you’re kinda out of luck. I used to work 6 days a week normally on salary and extra hrs at the end of the year, my boss tried to make it up by giving us a small bonus. It’s Japan, it’s expected of you to work yourself to dead for someone else.

  2. Usually Japanese salaries have “overtime” built into the salary (meaning they’re legally paying you for overtime even when you’re only working your normal 40 hours). For example, my contract mentions I receive overtime pay for something like 20 hours a month. Do I work overtime? No. But if I did, I wouldn’t be paid extra until I worked more than 20 extra hours in a month. Most likely you won’t get any extra pay, just like they didn’t give you less pay when you didn’t work a full 40 hours.
