Getting divorced in Japan (both US citizens).

We got married in the US. I’m working in Japan under an instructor visa, and my husband is on a dependent visa. What would be the simplest way to do the divorce? We were planning on visiting home in December, would it be easier to file while we are in the states? Or in Japan? I keep seeing posts on how to divorce a Japanese citizen, but not citizens of the same foreign country.

So many questions, just not sure where to start…

  1. Just so you’re aware, it does not necessarily affect you per’say, but your husband will lose his ‘Dependent’ visa after divorce.

    He will need to update immigration within 2 weeks after the divorce. See here: https://www.isa.go.jp/en/applications/procedures/nyuukokukanri10_00016.html

    I’d say it’s probably worth you submitting it too, just in case he “forgets” on account of you kinda being the sponsor for his dependent visa, you’re somewhat responsible for him.

  2. If possible, try to give him time to get another visa lined up if he is capable and wants to.

    (This means if he’s not a tool, not causing trouble, not assaulting you in any way)

    Where it would be easiest to do the divorce really depends on where the marriage took place.

  3. I think your divorce should be finalized in the States.

    Neither of you guys are citizens so there shouldn’t be a Koseki Touhon that would require amending via a rikon todoke.

    As far as the Japan side is concerned, I think you just have him move out, then you remove him from your jyuminhyo and your ex husband will have to change his visa somehow.
