Working without an employment contract?

I’ve been a manager at a mid-sized domestic company in Tokyo for several years now. My contract ran out earlier this year, and while I met with my department lead and went through the various recontracting meetings as usual, no new contract was issued.

It’s been some time now, I’m still working as usual and being paid on-time as usual, just without any contract or other documentation. I’ve raised the issue to HR several times now, and they don’t think it’s anything to be concerned about.

Is it necessary to have a written contract, or does an implied contract exist in its absence? Is this a situation I should be concerned about?

If anyone has advice or information, I’d really appreciate it – thanks.

  1. Your previous contract is deemed to have been renewed with an indefinite period. Pretty straightforward.

  2. You can reasonably assume that your contract has been renewed. You are still doing the same work, getting paid the same etc. The only question is if it’s indefinite now or the same duration as the previous contract.

  3. If you’re on a work visa you will likely need a valid contract when you apply for your next extension. If you have PR it doesn’t matter if you have a contract or not.

  4. I’d at least clarify your employment status. HR should be able to confirm this. If they ask, explain that you may need it for things such as visa, rental agreements, house purchases etc.

  5. My company renew contracts annually and make me sign it every times.

    I don’t think this is a problem if they didn’t do it. (though I can’t tell you if that’s legal)

    I never had any institution asking for it since I am in Japan. Only thing I have to produce time to time is a certificate of employment, but this is something that can be requested anytime to your company.

  6. Just ask for 在籍証明書 (employment certificate) and it should shows your type of employment (seishain or not). You’ll need this document when renewing visa anyway, might as well just ask now to make sure.
