Will I be rejected for PR if my husband moves out while it’s still processing?

I applied for PR in August and am still waiting to get the result. My husband was my sponsor. We are on our way to divorce and I would really like to not live with him anymore. If he moves out now, will it affect my chances of getting PR? My fear is that he has to register his address, so they might be able to find out we are not living together, which may make it look like a sham marriage. Is it better if he stays living with me until PR is confirmed?

By the way, the cops were called on us a few times recently because of our fighting. We didn’t get arrested or anything but they took down our names and information. Could that affect my chances too?

I really really want to get PR so I can get off my spouse visa and away from him.

  1. Hopefully someone will have better news for you, but for what it’s worth, while mine was processing they called my husbands phone to check that we were together. I think they called once while I was not around and asked for a time when they could call and we could both speak on the phone. I don’t know that this means they would reject you necessarily, but it’s something to consider. I’m sorry you are having to deal with this during such a stressful time, I hope things settle quickly for you.

  2. If you applied in August you should be close to getting it now. Maybe try to hold things together for another month or two.

  3. Even though you applied while in possession of a spouse visa, if you also work, have an income and a regular tax nenkin contributions, then you could still qualify for PR via the working route. Your husband moving out or separating would most likely disqualify you PR via the spouse route unfortunately.

  4. No one can say if yes or no in the case of living apart as it depends on the inspector.

    I would bet on rejection though.

    Even though married couples living apart is so common in Japan they have a word for the people in such a situation, Tanshinfunin, the prats at the immigration office expect us foreigners to be even more pure than so many Japanese in many ways.

    But yes, any talk of divorce will kill this application. You will need a new sponsor and a new application if they hear of it, or if you actually do get a divorce and file it, you are REQUIRED to inform them immediately.
