Please help, struggling to understand PR application rule

First time poster, I’m trying to get help with applying for my PR.

Unfortunately due to the fact I just turned 36 I no longer have the 70 points to qualify (currently have 65) for an “exception to the ten year rule”, however I had 70 points < 3 years ago.

Am I correct in my understanding that as long as one had 70 points within the last 3 years then I should be ok to still qualify? This is the sentence that I find a little confusing:

>Those with over 70 points when points are calculated as prescribed in the ordinance (hereinafter referred to as “Ministerial ordinance on highly skilled professionals”) which regulates the criteria in the lower column of the section on Highly Skilled Professionals in the Immigration Control and Refugee Recognition Act, Appendix 1-2, and who fall under either one of the following:

>
>Have resided in Japan continuously for over three years as a “Highly Skilled Professional”; or
>
>Have resided in Japan continuously for over three years and are recognized to have over 70 points when points are calculated, as regulated by the ministerial ordinance on highly skilled professionals, based on the time three years prior to the day of applying for permission for permanent residence.

Any help appreciated.

I will also contact an immigration lawyer, but just trying to workout if I should bother even discussing the PR or not.

    No, you need 70 points when applying and for the previous 3 years, since you no longer have 70 points you’ll need to wait for the 10 years to kick in or get more points.

  2. You need to meet the point requirement both at the 1) time of submitting the application and 2) three (if 70+ points) or one (if 80+ points) year(s) before the time of submitting the application.

    This means you may need to submit different documents for the different points in time, as well as two point calculation sheets.

  3. Are you on a spouse visa? If you’ve been married more than three years and have lived in Japan for at least a year, you can apply for PR:

    >2 原則10年在留に関する特例

    >**(1)日本人,永住者及び特別永住者の配偶者の場合,実体を伴った婚姻生活が3年以上継続し,かつ,引き続き1年以上本邦に在留していること。その実子等の場合は1年以上本邦に継続して在留していること**

    I know this, because I used it. After 10 years with my wife in the UK, moved to Japan in summer of 2017. Applied for PR in summer of 2018 and was accepted fairly quickly. Took almost no paperwork – didn’t need bank statements or anything. I showed them my tax return for 2017 – which only had like six months on it, as we moved back in the middle of the year. And showed that I was paid up on pension payments etc. My wife (doesn’t work outside the home) was the guarantor.

    Honestly, it was dead easy. It was more of a hassle getting my phone.
