PR point system: perf bonus ?

I have actually 75 or 80 points depending on the below situation (salary requirement).

My annual salary is 7,950,000 JPY (less than 8 Mil)

I have a 795,000 JPY bonus that is usually funded at 100% but it is theoretically possible that the company lowers it to 80% because of bad perf. It happens in some cases but I have never witnessed it so I guess it is rare.

I also have about 1,000,000 JPY of RSU a year.

Will the immigration consider that I am below 8 Mil ?
I would like to apply for the point system and get the PR in 1 year.

I am considering to apply through a lawyer but would like to avoid losing money because of this potential failure for the salary requirement.

  1. You don’t need to apply through a lawyer, if you are employed the process is pretty straight forward. Collect necessary docs including company issued one and fill the forms and submit.

    Immigration cares about what you earned therefore I think that you are above 8M JPY.

  2. So your base is 7,950,000 yen with a 795,000 OTE bonus? Then it seems pretty clear you are above 8 mil. Can you request a certificate of employment from your employer that lists both your base and OTE bonus?

  3. AFAIK when evaluating points immigration looks at past. If you meet condition for given year you are given points in that year (so you can e.g. cover lower salary earlier by being younger or being older by having higher JLPT proficiency, etc.). You need to have certain amount of points for certain amount of years _in past_ to be able to apply for PR through point based system. You know exactly how much money you have earned in past year(s) and prove that to immigration.

    Btw. from my own experience – they do not count RSU towards salary, only realized income (incl. bonus) for that criteria.

    Also, depending from where you are you might save a lot money by just applying directly. Its very easy and you need to secure most documents and guarantor by yourself anyway. From what I know, being from EU makes things a bit easier (I was approved with only 70 points after just one year living here, friend who is US citizen was rejected in same situation).

  4. Your company should give you a stamped letter with your current annual income and expected income for the current year. Those are the numbers you can use for the point calculation.

  5. A few ways you can go about doing this.

    1. If you have 75 points, just for wait for 2 more years (3 years) before applying
    2. If you are a little short, you can include your income from investments (let’s says dividends) to reach 8 mil.

    You don’t need a lawyer. Most of the legwork includes getting documents from tax office, city office, your company, guarantor… That’s doesn’t change even if you are using a lawyer. And they easily charge above 160,000 (a few years back)
