Wife’s family home parking lot suddenly refusing to rent the property

My wife has her family home in saitama (jikka). Both her mom & her dad operate 2 separate companies from their home (each have separate buildings). The father uses the parking lot for company cars (about 7 cars) while the mother uses the parking lot for customers who come pick up purchases (she runs a food business & sells large quantities of food to super markets).

They rent the parking lot from somebody & have for 50 years. The owner passed away & the daughter is saying they want the land back immediately & have involved a lawyer. My wife’s family has offered to buy the property for more than a fair rate but they’re no interested.

Legally is there anything my wife’s family can do? As this will massively affect both businesses.

I have no idea, but they should definitely consult a lawyer, because renting for 50 years is quite a number + it’s for business use, so I can’t imagine that it is that easy for the daughter to just claim it back without any regulations. I think with the lawyer she wants to intimidate your parents in law, so they should definitely consult a lawyer first and see if they have options. Too bad that they didn’t buy the property when the original owner was still alive.

  3. Well it isnt legal for the daughter to null their contract, and considering its been for more than 50 years ( i believe there is a legal clause where renting for that extended period makes its even harder to nullify it) shes going to have a hard time trying to do it.

    Its likely that the contract doesnt have an end date since its been so long. In that case she can get all the lawyers she wants but shes SOL.

    Either way, lawyer up

  4. Tenant protections don’t apply to parking lots, unfortunately. Everything will come down to the terms of the rental contract. If they have a 90 year lease with no cancellation clause, the daughter is outta luck for the next 40 years or so. If they have a month to month lease with a no-notice cancellation clause, then the daughter is within her legal rights.
