so my situation is quite complicated and cumbersome but ill save the details, originally was on 留学 visa, went to language school, worked on my business on the side, applied for change of status of residence to 経営管理 (ive been self employed for years with all of the requirements for that visa) in september, waited over 90 days with no response from immigration, 行政書士 withdraws my application because my school attendance rate was under 70% (which i was ignorant about the fact it affects your ability to get status change). She says they definitely wont approve it and its best to withdraw, cancel the 留学在留資格 AND leave the country, and come back and re apply for the same or a different visa. Not what i had planned.. and she charged me 800k yen with no refunds. I have been with my now wife since early last year, we married at the 役所in December, and i left to go to korea and come back in early January. We hired a new 行政書士 to apply for the spouse of a japanese (日本人の配偶者等) visa, and its been 75 days. I’m pretty sure what was applied for was a COE, i have a “在留資格認定証明書交付申請” receipt from the 行政書士. I had to include a 反省文 and all of the documents i submitted for my previous 経営管理 attempt with this COE application.
So from my understanding I have to receive another COE, and then apply for the spouse visa.
The main issue is my tourist visa ビザ免除短期滞在 expires in 3 days!
The 行政書士 said that it’ll be extended by 2 months beyond that due to “特例期間”. Here’s what he said: 特例期間というものが
適用されますので,4/10を過ぎても最長2ヶ月もしくは今回申請の結果が出るまで,
日本にいることができますので,何か特別な申請などを行う必要はありません
We’ve received 0 updates or requests for additional info from immigration.
Just wondering what i should do in this situation.
I’ve essentially been here on a tourist visa for 3 months unable to work or do anything while im stuck in limbo.
Any advice would be super appreciated

You should call immigration and ask them for an extension to your current status as a tourist while your application for the spouse visa is being processed.
Generally speaking you do get an automatic 2 month extension when you file your application, and you should have gotten a stamp or piece of paper with that written on it when the application was filed.

You’re also allowed to remain in Japan for up to 180 days without a status of residence in a trailing 12 month period, although I’m not sure how your previous residency would impact that.

So if it was me, I’d call Immigration directly and either get some physical confirmation of the 2 month extension or seek to have my tourist status extended by 90 an additional 90 days.
