Resigning from my work

Hi everyone,

I have a question, so I found a new opportunity and gave my 1 month notice. According to my contract it should be 2 months but I talked to my pic and it is negotiable. However, they ask me to add another 11 days which will be super giri giri to my new place start date. Can I actually say no and keep going with my planned 1 month day?

Based on what I’ve read here before, if you were a seishain in normal, full employment without any special contracts or on probationary period or something, you’re only legally required to give 2 weeks. It’s nice to do more, but that’s all that is legally required. Other situations all vary. I am not a lawyer. Anyone please correct me if wrong.

  2. Do you have any paid vacation days? A lot of people give two months’ notice but only work for one more month and then use up the paid holidays.

  4. I’m in a similar position as OP, working as 派遣社員 and wondering if the standard is 2 weeks – 1 month. If I recall correctly, I been told 1 month and I been planning on using my paid holiday before I quit. Would I be subjected to longer work days as new hires & responsibilities were added recently?

  5. as you have said it is negotiable. So yeah 30 days + 11 days is still within 2months.

    Sorry I forgot the exact wording in the labor law. It says you can pass your resignation 30days before the resignation date but employer might ask you to extend until they find a suitable person who will replace you.

    You can either check the labor laws again. But you signed the contract. No matter how you argue, they have proof.

  6. You mentioned in a different comment that you are a contract employee. Are you on your first contract or have you renewed it?

    If you’re on a fixed-term year to year contract and in your first year of employment, you are supposed to follow the notice period stated in your contract unless it were deemed excessive. However, I don’t think a two-month notice period would be considered so. If you’re on a fixed-term year to year contract but have renewed your contract and are in your second year of employment or greater, two weeks’ notice is all that is legally required, though most people give one month as a courtesy.

  7. I am also in this same process. According to my contract, I’m required to give three weeks.

    Would three weeks include weekends? So if I were to give my three weeks notice on 05/01, would my last day of my three weeks be on 05/22?

  8. I bounced out on a contract for a better job and nothing bad happened to me. The job I left fucking hated me and absolutely stiffed me money and treated me like shit for the two months notice I gave.

    Had I known that I woulda just walked out the door.
