I want to divorce my Japanese wife but worry about losing my son and visa

Hi all

My wife and I can’t really work things out who is Japanese (I’m from Europe) and I want to leave her. Will I be able to get a visa to work and stay here as our son has a Japanese passport? Can she stop me from seeing my son if we divorce and he primarily lives with her?

  1. I’m not a lawyer but a tiny speck of advice

    1) If you are dependent or spousal visa and do not have Permanent Residency, you’ll likely need to find an employer who is willing to sponsor your work visa.

    2) Custody of your son: In the event of a divorce in Japan, custody is usually awarded to one parent, and joint custody is not commonly practiced.

    Japanese family law tends to favor the parent who has primary physical custody of the child, which is usually the mother.

    However, the court will consider the child’s best interests when determining custody. Your ability to communicate with your child, your child’s ability to adapt to changes in their living situation, and the stability of the environment you can provide will all factor into this decision.

  2. Personally if you want to stay in Japan or even see your son ever again, I would at least endure it until you get PR status.

    Then you can divorce her, continue to live in Japan, and be within reasonable distance to be able to see your son.

    It’s also important to spend time with your son when he can actually remember you, otherwise you’ll just be a stranger gaijin guy he won’t recognize. And for that he would need to be at least 8 years old when you divorce
