planning on getting remarried

Hello, I have a question for those of you who may be in the know or have gotten divorced in Japan and remarried. When I first got married I had to get a certificate of no impediment to marriage ( CNI ) to confirm that I am indeed not married. However I recently wanted to get remarried with my new partner. If I apply for a CNI will my home country of Australia recognize that I am currently divorced and not in a married or will I have to take some extra steps before getting remarried?

  1. Did you notify Australia of your marriage when you first got married?

    If so, did you notify them of your divorce as well?

    I got married in France, divorced in Japan, then immediately sent some docs to France and they took 6 whole months to acknowledge that my divorce was acted in France. It now appears on my documents from France that I am divorced.

    Anyway, with international marriage you are supposed to keep your home country in the loop, but if you didn’t it’s possible Australia never even knew you were married

  2. Depends on your home country. I can’t comment about Australia but for Canada, you don’t need to notify them that you got married (like you CANT notify them, there’s no process, you’re just automatically considered married there too and you would need a translation of your marriage certificate if you ever moved back to Canada and needed to prove it, or needed to prove it for some other reason.)

    So because there’s no process to like “register” the marriage in Canada, there’s also no process to “register” the divorce in Canada. You’re just automatically recognized as divorced as long as the method of divorce was legal in the place of your residence.

    I’ve been remarried here and all I needed was to get the certificate of no impediment to marriage again from the embassy, the embassy doesn’t require any proof that you’re not already married or that you were officially divorced or anything (at least not the Canadian one) it’s just based on an honour system I guess and technically you’re “swearing it” like an oath so I’m assuming it would be some type of fraud or illegal if you lied, and then your marriage wouldn’t be valid if it was found out.

    So I got that certificate and then was able to register my second marriage normally at city hall

  3. If it anything like nz (i went through a similar thing recently). On the application form for the CNI it asks if you have been married before and details of when divorced. I then had to get a document from the city office (where i gave the divorce papers) to prove i was divorced

  4. I (living in Japan) divorced my partner (living in America) as we had been separated for 2 years. Divorce was filed in America, and I received the documents stating as much from my now ex-wife. Another 2 years later, I remarried in Japan and just had to show those papers that I had divorced. Wasn’t really any more to it than that.
