Leaving job due to injury

Hello. I’ve been working at a fairly large Japanese company in on of their izakaya chains as a 正社員 for over a year. Since December Ive had a pain in my elbow and I think its due to repeated use. The hours are long and strenuous (13 hours a day) and i thibk its taking a toll on me. I want to leave but I was wondering if I could collect unemployment for leaving due to injury or would I have to wait 3 months. Thanks for the help.

  1. You could go to the doctor, get a paper saying you can’t do work that strains your elbow. Since you are a 正社員 they would have to accomodate you. You could also go on medical leave which would put you on leave at 70% pay or so.

  2. Are you implying leaving your job permanently (resigning) when you say “leave?”

    I believe one of the conditions for loss of employment due to injury is that your injury renders you unable to find employment despite wishing to do so.

    Unless your elbow pain is so severe that it hinders your ability to work, then I doubt it will meet the required conditions.

    I could be wrong, though.

    Have you sought treatment yet?

  3. It seems like you are trying to game the system. You claim to have an injury but haven’t bothered going to the doctors yet.

    I hope nobody encourages him as everyone’s tax dollars will be needed to bankroll his extended holiday.

  4. Your first step is going to be documentation of the injury. I understand you work long hours but it’s not going to go anywhere until it’s documented. If that’s what you want to do (say keep your job but also get better. Or be on temporary disability.)

    The second step is if they’re breaking labor laws to pursue it through the labor boards. Again, if they aren’t accommodating your documented injury and also violating working conditions, you’re the only one that can pursue this. I understand you have limited free time but the ball can’t get rolling until you push it.

  5. I had the same experience as OP. Working 13 hours every day, being told to clock out so the 本社 won’t see how much overtime they are making me do. I had a miscarriage because even after being told to be in bed rest, my general manager still didn’t allow me to take an off. I blame my self for not being able to stand up for myself and my unborn child up to this day.

    Long story short, collecting unemployment would be a bit of a hassle unless you have proof of the things you said like making you clock out and still making you work. If you don’t have those proof they can’t consider it as work abuse so you would have to wait for months and also show up in HelloWork a few times. I hope this helps and that things get better for you OP.

    PS. Go get your elbow checked before it gets worse.

  6. Tennis elbow. I get it from time to time too. Been a chef for 25 years. Find a darts store and ask for an elbow support and describe your issue. Those compression bands are a fucking life saver
