Company bankrupted during my childcare leave. Anyone have any advice on what steps to take?

My company bankrupted while I am on childcare leave so my understanding is that I won’t receive the childcare leave payments anymore. I had extended my childcare for the next 6 months so it’s unlikely my child could get into daycare, especially now that I don’t have a job.

I’m searching up things about 失業保険 and whatnot but if anyone has some knowledge about this area I’d appreciate any advice. I’m trying to read up myself but it’s a slow process for me when everything is in Japanese unfortunately.

  1. My company informed us of a major RIF (US-HQ’d company) 2 weeks after I delivered my child.

    I negotiated to remain “on the books” through the end of my planned childcare leave, which was within the timeframe of formally shuttering the KK branch company. I also received severance.

    I would speak with an employment law lawyer to see what your options are.

    But yes once your employer disappears or you sign a formal retirement, your benefits cease.

  2. I’m sorry to hear about your situation.

    Your first stop needs to be Hello Work. They have translation services and can clarify the situation regarding your childcare benefits.

    Then your next stop is your local city hall/ward office to explain the situation and find out what your options are for childcare. Do this now, as being on childcare leave should give you more points than being unemployed.

  3. I don’t have any advice relating to childcare leave, but pay attention to how your company performs the layoffs. One of my previous employers “bankrupted”, yet fired everyone as “voluntarily resigned”. So make sure you keep constant copies of all timesheets and conversations before you lose access, and don’t sign any contracts without reviewing them with a 3rd party.

  4. With regards to daycare, there are temporary options which would allow your child to be looked after while you job hunt, go to interviews etc. Once you have work you can transfer to a permanent daycare.

  5. It shouldn’t be that hard to find an empty daycare, but it might depend on where you live. In Koto-ku there are plenty with free spots available – you should be able to find this list at your municipality’s website.

    You should also still be able to apply for a daycare with the assumption that you’re looking for a job (you’d need to find one in ~3 months). This rule is something you’d have to double check though, I’m just speaking from the more common “quit your job during childcare leave” perspective.
