  1. The article’s author considers the lawsuits “failed” because no damages were awarded. That’s pretty common in such lawsuits because they have to sue for damages in order to get the lawsuit taken up in the first place. It’s the constitutional issue that’s important and the reason for the lawsuits, not the monetary damages.
