US & JP double taxed

Howdy y’all

I work in japan & receive a paycheck directly (contract, not seishain). I sent an invoice with the estimated Japanese tax for them to withhold. They then send the after tax amount to me.

I also pay health insurance on my own in japan.

My US CPA told me that these taxes paid in JP cannot be claimed in the US because I’m not seishain. So I’m being doubly taxed.

This surely can’t be accurate right? Is anybody in a similar scenario?

  1. Are you a legal resident of Japan with a valid visa that allows you to work remotely?

    Reminder: you can only work remotely on a spouse visa, Designated Activities visa and if you are a citizen or have permanent residency.

  2. I’m confused about you receiving the full paycheck, then later having tax withheld.

    Anyway, if you’re paying tax in Japan (which you should be) you can file a foreign tax credit form, OR a foreign earned income exclusion form. I always file the exclusion.

  3. Why are you trying to claim taxes in the US? Your whole income is excluded if you are a tax resident in Japan (unless you make something like over $100,000). File the 2555.

  4. Seishain or not has absolutely nothing to do with it. Your US “accountant” is very wrong; find a non-stupid one.

  5. Please find a tax accountant who is knowledgeable about international taxation. Most US based tax accountants are not.
