  1. Has there ever even been one international child custody case where a Japanese court ruled against the wishes of the Japanese parent?

  2. This comments on threads for this specific case almost always go towards international child abduction and the Hague treaty. It should be noted that this in **not** an international custody case. While it’s a “international couple”, this is completely a domestic custody case, where the kids were born and raised in Japan. It highlights the issues with the lack of joint custody and visitation and paternal rights within Japan and this case would likely play out the same if the father was Japanese. One parent can abduct and hide the children from the other and as long as those children are safe, the police and courts will do nothing.

  3. Step 1 *claim DV*
Step 2 *kidnap children because of said DV*
Step 3 *lose or forfeit DV case*
Step 4 *get custody right over kidnapped children because they have been together more than 6 months*

The usual pattern in Japan. It’s like an uncounterable attack combo that you can’t do anything against. The time the DV and custody case gets finally judged by the tribunal, the latter will confirm the right of custody to the abudcter because the judge consider the stability of the children psyche and environment more important than anything

Although this case has been reported because of its international aspect and the fight of the father, according to association there are approximately 100 000 case per year that occur in Japan.
Knowing the average has been 1 million per year for the past 10 years, it’s decreasing, that makes a real big percentage of children related to this case

  4. The judge ruled that the woman “should” let the father see his children. But what happens to the woman if she decides she “shouldn’t”?

  5. It’s interesting how the mom is always japanese whenever i hear about this stuff. I guess japanese dudes don’t really marry foreigners
