Is it legal to use all my remaining leaves to shorten my notice period?

I am in my 3rd year in the company now. My contract says that I should give a one-month notice. Let’s say I am planning to submit my resignation on December 15. I plan to say that I want my last day of employment to be January 15 but I want to use all my remaining vacation leave and there is the winter break (December 29-January 7). Thus, making my last day in the office, December 21. Am I breaking my contract here? or is using all my remaining leaves to shorten my notice period perfectly legal?

  1. 2 weeks is legal requirement. 1 months is being nice and recommend it.

    Holidays don’t reduce required notice but you are free to take them as you see fit. So if you have two weeks holidays batch take them towards end yeah. That is not a problem

  2. That’s legal and actually not shortening your notice period because you are still employed while on vacation.

    On the other side of the coin, if you don’t manage to use up all your days before your last day of employment, you probably get nothing because this is not Europe.

  3. Generally the standard practice is doing what you are describing. Declare 1 month before you leave and use all remaining paid leave at the end.

    A lto of people have recommended that I also use my paid holidays when quitting as ell (quitting literally right now).

    Plus you can’t take it with you, so would say go for it.

  5. It’s suggested practice at a lot of companies, mine included. Submit your termination and burn all your remaining days off. The company would rather you do that, than have the black mark of yet another employee who never took holidays.

    There is no legal requirement for the company to reimburse you for unused vacation days.
