Company demanding compensation for breaking contract

My eikaiwa is closing at the end of the school year, so I’ve been job hunting and got an offer that wants me to start in January. My eikaiwa is now demanding compensation for all my classes January-March. Is this legal? I’m on a fixed-term contract that expires in March. I’ve tried to find information about how much notice is required for quitting on a fixed-term contract (my work contract doesn’t have a set notice length) and/or how much exactly a company can sue the worker for breaking contract for. Where should I contact for help?

  1. It would cost them more to sue you than what you owe.

It’s eikaiwa. They hire illiterate migrant workers because they can lie to them and cheat them out of pay.

  2. If this is the first year of your contract, they can demand compensation for breaking the contract.

If it’s beyond your first year, they cannot.

  3. If it’s a 1-year fixed term contract not renewed from a previous contract, then technically they can claim any actual damages they have from you leaving early. No extra penalties or anything, and the courts tend to be skeptical of their claims.
