So I work for a security company and was recently moved to a shift where we patrol from 11:00 to 19:00 for roughly 20-25k steps with a 1h break.
So I believe I strained a muscle in my knee while working and had to take November 21st to the 30th off because I couldn’t walk without limping.
My contract says I am guaranteed 160 hours of pay and the work schedule will be confirmed via LINE. October I worked 140h but was paid for 160.
This is the exact relevant writing in my contract:
ライン連絡等により予め従事可能な希望日に拠り合意した勤務日・時間に就業します。1ヶ月の変形労働制が適用されますが、1月の労働時間につき、1.60時間に満 たない場合は、規定時給の160時間分(¥240,000) を保証します。
According to Google, it says that days off from the agreed work schedule will be deducted from the fixed salary which is fine, but my employer said I will only be paid for the hours I worked that month which is 75 hours. I thought based on the Google result I would be paid 160h – the scheduled hours of work prior to injury(I think 6ish days) 7hx6=42h so 118h?
They told me one of the reasons was because the other workers didn’t have any injuries, therefore the workload is reasonable and the injury is my fault.
So my question is, is this fair?

They aren’t responsible for paying you for the hours you didn’t work, that’s what insurance is for.

There is a whole booklet that goes through how to claim insurance. Basically you get treated and fill out forms and give them to the labor inspectors office.
I’m willing to be documenting everything is important and keeping receipts for medical expenses and getting proof of injury.
You must use your paid time off. As long as you worked all business days in the month, you will receive the full month salary that was promised even though the actual work hours is less than 160. But if you miss a day, they will deduct it. monthly wage / business days * days absent = your deductible
