Smoking outside property

I live in a townhouse arrangement (bottom floors is our) but there is someone living in the top floor. We rent the bottom floor and the outside car parks.
I have heard the upstairs’ tenant take a photo (not sure if i am being paranoid if its me or the sun/outside) but i am sure that law is that i cant smoke inside a rented property (not that i would smoke inside).
Is it illegal to smoke outside your home? I mean i consider this private property but not entirely sure if Japan would classify this public.
I live kind of rural (45 mins out from Fukuoka) so my thought is that the smoking would be ok on private property and i cant get in trouble from the landlord who i have not heard anything from since the first image was taken about a month ago?
I tried posting in several subforums but banned as i was not living in Japan at the time of post (Just a fyi).

  1. The laws here regarding where you can smoke are really tricky. My first year in Japan (Ibaraki at the time), I had a friend come to visit. He went outside to smoke a cigarette and got the cops called on him because he was “standing too close” to my neighbor’s driveway. Honestly, it probably comes down to being suspicious of foreigners standing around more than anything.

  2. If the smoke enters their space on the regular they might complain about it, but I guess aside from getting the police called on you, nothing else will happen.

  3. This would be based on the rules your building, landlord and lease. Plenty of rental properties *only* allow smoking indoors as balcony space is often considered common space. Also, smoking outdoors is often prohibited because of hanging laundry.

    Dude probably gets smoke into his apartment through open windows when you smoke out front.

    Walk a bit away from the townhouse so he doesn’t get any in his apartment.

    My downstairs neighbor smokes and it drives me nuts when I have my balcony window open and my entire apartment smells like smoke

  5. Thanks for all the feedback – i am looking to buy a ploom (or x) and do some research for these devices that are smoke free. I assume i need to buy a separate sticks for the cigarette component for these
