Friends situation ->1 of 2 Co-directors of a school (unsure if it is a KG or GG). Has a visa through the other co-directors other business.
The other co-director has been withdrawing funds for personal use, or to cover expenses for another business, directly from the school/company bank account and now is looking to shut down the school. She is claiming this is all legal, as he is her “employee”, ignoring his co-director status with said company.
She is looking to shut down the school, and as the clients are connected to the corporation, he will not be able to bring to set-up a new school with the existing clientele. She is also claiming various other non-compete clauses.
She has a lot of leverage in this situation, and it is time for an expert. However, he is very short on funds and I am unsure what to recommend.
I desperately want to be able to give useful, helpful advice and not sound like “captain hindsight”, but I am struggling here.
