Hi All,
I joined a new company in May of this year with a probation period of 6 months.
My performance has been good but the job has crazy overtime and lacks psychological safety which has been affecting me mentally (lack of sleep, anxiety, feeling deflated and depressed).
I want to find another job but I don’t have the time/energy to do that now. I am considering taking stress leave as I am at a breaking point now, but I am also under probation.
a) Would I legally be entitled to stress leave considering Im on probation?
b) The work rules state that the company has the right to dismiss me if my mental or physical state does not allow me to work during probation. Does this hold up legally?
For context: company is a large international company and I am working in their Japanese subsidiary as Seishain.
