I have to pay rent in advance but I want to move out.

I want to move out of my apartment on the 9th of may. The contract states that if I want to move out I have to say that 2 months ahead. The problem is that I lost my job in Japan and I am not able to pay rent anymore. That is why I have to move out and flying back to Germany. I have a work and travel Visa. I am trying to talk to my landlord but he wants me to pay the 2 months rent when I want to move out. I am trying to talk to him but he refuses to find a solution. Is there anything I can do? I do not have the money to pay him.

    There’s probably nothing you can do. The penalty sounds pretty reasonable. If you don’t pay, they will go after your guarantor. Mostlikey another no foreigner landlord will be born, and rightfully so.

  2. Legally, there is not much that you can do to change the terms of the contract. Since your guarantor will be responsible for the debt if you cannot pay, you should tell them about the situation and see if you can borrow money from family.

  3. Why do you need to fly back to Germany ?

    If your visa is still good, find another job : factory, eikawa, construction, … you could even find some which are paid daily.

    Try to find some family member/friend can lend you some money to pay rent, if not explain to your landlord you are a bit in trouble for money and request a delay to pay rent. Put your moving out in 2 months notice and confirm with your landlord the moving out fee. Save money to not end up in this kind of situation again. Find a staying place more fitting to your life style for from in 2 months to the remaining of your visa.

  4. A friend of mine was in the same situation, and he discussed with his agency and landlord that he was really unable to pay everything (2 months of rent + cleaning fee) at once, and asked if he could break it down ( 40000 x 4 months). When he left Japan, he didn’t close his bank account, asked a friend to put money in it so the landlord could automatically abstract it, and transferred money back to that friend.
    I guess that’s one of your option
